A Sudanese refugee drug dealer has been sentenced to five years’ jail for raping a 15-year-old girl he sold cannabis to in Toowoomba, Queensland.
Jok Bol Deng, 25, was charged with two counts of rape and two counts of supplying drugs to a minor over the sex attack, which occurred inside his home in 2023.
Deng pleaded guilty on September 30, and appeared in the Toowoomba Supreme Court where he was handed the five-year sentence, but with 636 days spent in custody declared as time served, was immediately eligible to apply for parole, the Toowoomba Chronicle reported.
The court heard Deng invited his victim, who he had met a few times previously to facilitate drug deals, to his home to smoke cannabis, and when she walked in gave her a bong and rolled himself a joint.
Crown prosecutor Abby Kong told the court the girl vomited and asked to lie down, but Deng then raped her while she was too sick to speak or move. She said the victim was in pain, and felt like the attack lasted for hours.
The next morning Deng raped the girl again, but Ms Kong told the court he was to be sentenced on the basis that he unreasonably believed his victim was consenting.
The court heard Deng came to Australia as a child refugee from Sudan, was on a permanent visa, and had paranoid schizophrenia, but his barrister told the court Deng gave instructions not to put any information on the public record about his background, his family members or why he came to Australia.
Deng had unrelated convictions for drug dealing, cannabis production, assaulting and spitting on police, damaging police property and breaching his bail conditions, and had spent a total of 921 days in custody, only some of which was for the rapes.
The court heard that Deng now faced having his visa cancelled and could be deported, but that it was at the discretion of immigration minister Tony Burke.
